About these terms
These terms govern your use of deventerprise.com (the "site"). The site is operated by DevEnterprise Software Limited ("we", "us"), a company registered in England and Wales under company number 15160932, with its registered office at Suite 4434a, 60 Tottenham Court Road, London, W1T 2EW, United Kingdom. By using the site you agree to these terms; if you do not agree, please do not use it.
These terms cover this website only. Our products, ScrAPI (scrapi.tech) and Directory Monitor (directorymonitor.com), are provided under their own terms, licences and privacy policies, published on their own websites. Nothing on this site forms part of a contract for those products.
Using the site
The site is provided free of charge to give information about our company and products. You may view, download and print pages for your own reference. You must not:
- use the site in any way that is unlawful, or in breach of these terms;
- attempt to gain unauthorised access to the site, the server on which it is hosted, or any computer, database or system connected to it;
- knowingly introduce viruses, malware or other harmful material;
- use automated tools in a way that damages, overloads or impairs the site or interferes with other people's use of it; or
- reproduce, adapt, distribute or commercially exploit content from the site, other than as permitted below, without our written permission.
Intellectual property
The content of the site, including its text, design and images, and the DevEnterprise, ScrAPI and Directory Monitor names and logos, is owned by DevEnterprise Software Limited or its licensors and is protected by copyright, trade mark and other intellectual property laws. You may quote short extracts with attribution and a link to the source. Any other use requires our permission.
Code we publish as open source on GitHub is licensed under the licence stated in each repository, which governs that code instead of these terms.
Information on the site
The site is for general information. We take reasonable care to keep it accurate and up to date, but we do not promise that it is complete, accurate or current, and we may change or remove content at any time without notice. Product features, pricing and availability are described on the product websites, which take precedence over any summary here. Nothing on the site is advice on which you should rely, or an offer capable of acceptance.
Links to other sites
The site links to websites we do not control, including GitHub, LinkedIn and Google Maps. Links are provided for your convenience and do not imply endorsement. We are not responsible for the content of those sites or for how they handle your data; their own terms and privacy policies apply.
Our liability
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under the law of England and Wales.
Subject to that, the site is provided "as is" and, to the fullest extent permitted by law, we exclude all conditions, warranties, representations and other terms that might otherwise be implied by law. We will not be liable for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty or otherwise, arising from your use of, or inability to use, the site or its content, including any indirect or consequential loss, or any loss of profit, business, revenue, goodwill or data.
If you are a consumer, these terms do not affect your statutory rights.
Viruses and security
We do not guarantee that the site is free from bugs or viruses. You are responsible for the security of the device and software you use to access it. Attempting to gain unauthorised access to the site or to attack it is a criminal offence under the Computer Misuse Act 1990; we will report any such attempt to the relevant authorities and cooperate with them, and your right to use the site will end immediately.
Privacy
Our privacy policy explains what personal data the site collects, why, and your rights over it.
Changes to these terms
We may revise these terms from time to time. The version published on the site when you use it is the version that applies; the date at the top shows when it was last updated.
Governing law
These terms, and any dispute or claim arising out of or in connection with them or your use of the site, are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident in Scotland or Northern Ireland you may also bring proceedings in the courts of your home nation.
